Apple files Chinese trademark to protect Smart Cover

Patently Apple

A few weeks ago, Chinese accessory makers fired off a Smart Case for the Samsung Galaxy Tab, claiming it was endorsed by Samsung, that looked remarkably similar to Apple’s Smart Cover for iPad 2. Apple has now filed a figurative trademark in China to protect the Smart Cover design.

Samsung has since revealed that it did not officially endorse the Smart Case accessory and has distanced itself from the case. That hasn’t stopped Apple from acting, however.

Patently Apple has uncovered an official figurative trademark for the Smart Cover in China, which if/when granted, should allow Apple to issue cease and desist notices to any companies attempting to mimic the Smart Cover design.

A figurative trademark will protect the shape and look of the case, whereas a word trademark would protect the name “Smart Cover.” Apple has applied for the word trademark in the U.S., Canada, Europe, and China.

Should Apple pursue overseas trademark litigation or just let the copiers have their fun? Let me know your thoughts in the comments!
